ATI’s Wynn at ALEC: Is the Cross State Air Pollution Rule Even Needed?
ATI Fellow Todd Wynn at ALEC: The U.S. Environmental Protection Agency’s Cross-State Air Pollution Rule (CSAPR), approved in July of 2011, aims to reduce power plant emissions that cross state lines and contribute to ozone and fine particle pollution (PM2.5) in the eastern United States. The first phase of the rule will take effect on January 1, 2012, and it requires reduction of power plant SO2 emissions by 73 percent from 2005 levels and NOX emissions by 54 percent. But a recently released study has shown that the EPA has relied on old emissions data and does not take into account recent upgrades that have led to drops in emission levels. This means the entire justification for the CSAPR is unnecessary.

Not only is it not needed, but it is not Constitutional. This is a matter for the states.
