American Tradition Institute today launched the first in a three-part series of videos that explains why its Environmental Law Center sued the State of Colorado in federal court, claiming that the state’s Renewable Energy Standard violates the Commerce Clause of the Constitution. It is the first legal action by the law center, which is led by director Dr. David Schnare. In the first video Dr. Schnare explains the lawsuit’s premise: How wind power is not clean or free, as many environmental groups claim, and therefore does not provide a local benefit to Coloradans.
“We’re putting wind on trial because people don’t understand the facts behind wind,” Dr. Schnare says. “We believe that if people knew how variable wind was, and how dirty it was, if they knew the wind was neither free nor clean, then they may not have government demand its use.”
The lawsuit was filed in federal court in Denver on April 4, 2011. The Law Center has already drawn widespread attention to its work, with three high-profile lawsuits:
- The lawsuit against the State of Colorado
- A Virginia Freedom of Information Act lawsuit against the University of Virginia to gain the release of records that pertain to Climategate scientist Dr. Michael Mann
- A federal Freedom of Information Act lawsuit against NASA to obtain the outside employment records of global warming activist Dr. James Hansen
“We took this lawsuit because we are a pro-environmental organization,” Dr. Schnare says. “We have found — as have others — that use of renewable energies can cause more pollution than it prevents, and it’s also unconstitutional.
“So we’ve taken this case to try to fix the problem that is both a legal problem, and an environmental problem.”
Part 2 of the three-part series, which explains the constitutionality questions behind the law center’s case against the State of Colorado, will be released early next week.
